1. GENERAL
1.1 The protection of your personal data is a top priority for eunomia – co-operation of independent attorneys (hereinafter: "we" or "us"). We collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or in accordance with any other legal basis in accordance with the General Data Protection Regulation and all other applicable national and European regulations.
1.2 Controller
The independent lawyers Dr. Roland Gewessler, Dr. Martin Kirchmayr, Priv.-Doz. MMag. Dr. Martin Oppitz and Dr. Alexander Russ are responsible within the meaning of the data protection laws for the processing of personal data described in more detail in this privacy policy.
1.3 Personal data
‘Personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons and biometric data such as fingerprints name, an. We only collect personal data that is necessary for the performance and processing of our legal services or that you have voluntarily provided to us.

2. DATA PROCESSING WITHIN THE FRAMEWORK OF A CLIENT RELATIONSHIP
2.1 We will not process the data provided to us for purposes other than those covered by the engagement agreement or by your consent or otherwise by a provision in accordance with the GDPR.
2.2 Your personal data will be processed to take steps upon your request prior to the contractual relationship or in order to perform our contractual obligations (Art 6 para 1 lit b GDPR) within the framework of the attorney-client relationship and to fulfill our legal and professional obligations (Art 6 para 1 lit c GDPR).
3. DATA PROCESSING IN THE CONTEXT OF JOB APPLICATIONS
3.1 We process your personal data upon your request in order to take steps prior to the contractual relationship (e.g. conclusion of a service contract, Art 6 para 1 lit b GDPR), if we wish to keep you on record as an applicant and to fulfill our legal obligations (Art 6 para 1 lit c GDPR). We process your data in order to handle the application process and registration with the social insurance. We cannot process your application without the provision of your data.
3.2 Your data will be processed by us for the duration of the application process and beyond, insofar as legal claims can be asserted against us (therefore at least for 7 months after a rejection due to possible claims under the GlBG). In addition, your data may be stored upon your consent for further record keeping.
4. DATA PROCESSING IN CONNECTION WITH OUR WEBSITE
4.1 We process your personal data to safeguard our legitimate interests (Art. 6 para. 1 lit. f GDPR), namely to ensure the operation, security and optimization of our website, to process your inquiries t you send to us via the contact form on our website, by e-mail or by telephone (Art. 6 para. 1 lit. a GDPR) and to fulfill our legal obligations in connection with the prevention of money laundering and financing terrorist activities (Art. 6 para. 1 lit. c GDPR).
4.2 Log files
When operating the website, the following access data ("log files") provided by your internet provider may be stored in the course of your use of the website
– IP address and IP location
– Referrer URL (the previously and subsequently visited website)
– Number, duration and time of visits (your interaction with the website)
– Search engines and keywords that you used to find us
– Browser type, screen size and operating system
We process these log files in order to ensure the functionality, stability and security of the website. We may also use this data in connection with forensic investigations in the event of a security incident or to compile user statistics. Only anonymized versions of your IP address are used in connection with statistical purposes. The legal basis is our legitimate interest in this respect (Art 6 para 1 lit f GDPR).
4.3 Cookies
This website does not use cookies.
5. TRANSFER OF DATA TO THIRD PARTIES
5.1 In order to perform our contractual obligations, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers we use and to whom we make data available, etc.), courts or authorities. Our data processing providers, i.e. IT service providers, providers of data management systems for legal software including cloud solutions, process your data in accordance with our instructions. Your data will be forwarded exclusively on the basis of the GDPR, in particular to fulfill our contractual obligations to you or on the basis of your prior consent.
5.2 Furthermore, we inform you that in the context of our legal representation and support, we regularly obtain factual and case-related information from you from third parties.
5.3 Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection, for which we conclude standard contractual clauses.
6. DATA RETENTION
6.1 We will only retain your data for as long as is necessary for the purposes set out above and to fulfill our contractual and/or legal obligations. If we no longer need your data, we will anonymize or delete it to ensure that you can no longer be identified. Personal data will be stored in particular for the duration of the contractual relationship and within the scope of the statutory retention periods or beyond that if there are legitimate interests in further processing, such as the assertion and defense of legal claims. If necessary, we may also retain your data as long as potential legal claims against us are not yet statute-barred.
7. YOUR RIGHTS
7.1 You have the right at any time to request information about which of your data we process (Art 15 GDPR), the right to have your data corrected or deleted (Art 16 GDPR), the right to restrict the processing of your data (Art 18 GDPR), the right to object to data processing (Art 21 GDPR), the right to data portability (see in detail Art 20 GDPR).
7.2 If your data is processed on the basis of your consent, you have the right to withdraw this consent at any time by sending an email to office@eunomia.at or by post to eunomia Rechtsanwälte, Strauchgasse 3 / DG, 1010 Vienna. This does not affect the lawfulness of the data processing carried out up to this point in time (Art. 7 para. 3 GDPR).
8. GOOGLE MAPS
8.1 The website uses Google Maps to display map information. Google Maps is a map service of Google Inc ("Google"). Each time you access a page on this website that uses Google Maps, a direct connection is established between your browser and a Google server in the USA.
8.2 When using Google Maps, Google also collects, processes and uses data about the use of the Maps functions by visitors to the websites. If you do not want Google to collect, process or use your personal data via this website due to the use of Google Maps, you can deactivate JavaScript in your browser settings. However, if you deactivate it, you will no longer be able to use the map display function.
